District Judge Upholds Federal Right to Remove Southern Border Fence

Judge criticizes federal border policy, but says fence removal is legal.

District Judge Alia Moses recently ruled that the federal government has legal grounds to remove the razor wire fence installed by the state of Texas along the U.S.-Mexico border.

Texas officials have taken action to discourage the illegal crossings by migrants into the state, and have expressed opposition to the border policies of President Biden’s administration. One of the measures the state used was to install razor wire fencing in certain spots along the southern border, which President Biden administration’s began to take down in the last few months.

The state filed a motion to block the federal government’s removal of the fencing in October. While Judge Moses expressed understanding of Texas’ situation, commenting about the administration’s “utter failure” to secure the southern border in her written order, she said that the national border ultimately falls under the jurisdiction of the federal government, not the state. Texas may continue to press its proposed block forward in higher courts, but Judge Moses said that it was unlikely to succeed.
